The company USABoutique, s.r.o., ID: 28786131, with registered office: Kubelíkova 1224, Prague, 13000, registered in the Commercial Register kept by the Municipal Court in Prague, Section C, Insert 182565 C, (hereinafter referred to as "USABoutique"), as the data controller, hereby takes the liberty to inform you, as the so-called data subjects, about the manner and scope of processing of personal data by USABoutique, including the scope of your rights related to the processing of your personal data by USABoutique.
1. What personal data does USABoutique process about you?
USABoutique processes, in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation; hereinafter referred to as the "Regulation"), and in accordance with relevant national data protection legislation, personal data that you provide to USABoutique in connection with the purchase of goods or the use of services (e.g. You may also use the personal data you provide in connection with the use of USABoutique.cz in ordering goods in the e-shop, subscribing to the USABoutique.cz newsletter or when making a complaint. This personal data includes:

2. For what purposes and on the basis of which legal titles does USABoutique process your personal data?
    Processing of personal data in connection with the purchase of goods in the e-shop
        The processing of personal data is necessary for the purposes of concluding the purchase contract and its subsequent execution, delivery of the ordered goods and also for the fulfilment of legal tax obligations.
        In the case of creating an order, USABoutique collects and processes your personal data in the following scope - name, surname, residence or delivery address, telephone number, e-mail address. The provision of this personal data is a prerequisite for the conclusion or modification of a purchase contract, whereby the provision of personal data serves primarily to identify you unambiguously and unmistakably and to contact you for the purpose of delivering the ordered goods.
    Processing of personal data in connection with the handling of complaints, enquiries and complaints
    The legal basis for the processing of personal data is the fulfilment of USABoutique's contractual and legal obligations. In connection with the handling of complaints, USABoutique also processes personal data for the purposes of its legitimate interests in the event of a possible dispute arising from a complaint.
    When handling complaints, USABoutique collects and processes your personal data in the following scope - name, surname, residence or delivery address, telephone number, e-mail address, transaction history of orders, data on purchased goods.
Processing of personal data in connection with customer account management
If you register as a USABoutique.cz user, USABoutique processes your personal data for the purpose of maintaining your customer account. The legal basis for the processing is the performance of a contract, i.e. negotiations for the purpose of concluding a purchase contract, delivery of ordered goods, related communications and also for the purpose of fulfilling legal tax obligations.
In the case of customer account management, USABoutique collects and processes the personal data of the data subject in the following scope: name and surname, e-mail address, telephone number, residence or delivery address, password in encrypted form, profile information such as age and gender, data relating to purchases made (e.g. type and price of goods, date of purchase, data on the status of the customer account).
Processing of personal data for sending newsletters (commercial communications)
In case you register your e-mail address to receive newsletters, USABoutique will process your personal data in the scope of - e-mail address, based on your consent to the processing of personal data for the purpose of sending offer e-mails and other commercial communications by electronic means according to Act No. 480/2004 Coll., on certain information society services. USABoutique will start processing your Personal Data only after you register your e-mail address to receive newsletters on USABoutique.cz and then complete this registration by confirming your consent to the processing of personal data in the received e-mail message. If the registration is not completed in the above manner, your e-mail address will be removed without undue delay.
In the case of existing customers, USABoutique may process your personal data in the scope of - first name, last name, email address for the above-mentioned purpose on the basis of a legal title of legitimate interest.
Processing of customer data with consent for marketing and commercial purposes
If you consent to the processing of your personal data for marketing and business purposes, USABoutique will process your personal data in the following scope - name, surname, gender, age, email address, IP address and derived location, data obtained from cookies and similar technologies, data relating to purchases made, browser and device data and, where applicable, other online identifiers, primarily for the purpose of creating an appropriate offer of goods and services from USABoutique or third parties and in connection with reaching the customer, through all means of internet advertising and through electronic communication for sending personalised offer e-mails, targeted advertising and other commercial communications by electronic means pursuant to Act No. 480/2004 Coll., on certain information society services, as amended.

3. For how long do we process your personal data?
USABoutique processes your personal data in the case of purchase of goods in the e-shop for the duration of the contractual relationship, as well as for the time necessary to ensure the mutual rights and obligations arising from the contract and for a period of 2 years from the date of expiry of the warranty period for the purposes of USABoutique's legitimate interests (see above). In accordance with Article 35 of Act No. 235/2004 Coll., on Value Added Tax, as amended, the tax documents issued shall be archived for a period of 10 years from their issue. Due to the need to prove the legal reason for issuing tax documents, orders are also archived for 10 years from the date of dispatch of the order by the customer.
In the event that USABoutique processes personal data on the basis of your consent to the processing of personal data for marketing and commercial purposes or for sending commercial communications by electronic means pursuant to Act No. 480/2004 Coll., on certain information society services, as amended, personal data will be processed for a period of 5 years or until you withdraw your consent. If you withdraw your consent, this does not affect the processing of your personal data carried out by USABoutique for other purposes and under other legal titles, in accordance with this Privacy Notice.

 

 

4. Who all will have access to your personal data?
In addition to USABoutique and its employees, personal data may also be processed by USABoutique's partners for the purposes described above. The external partners who may process your personal data as processors are carefully selected by USABoutique and only entrust personal data to those partners who provide sufficient guarantees to ensure appropriate technical and organisational measures so that, in particular, accidental or unlawful destruction, loss, alteration, unauthorised disclosure of, or unauthorised access to, the personal data transmitted, stored or otherwise processed cannot occur.
The entities that may have access to your personal data are or may in the future be:
Persons who provide the technical operation of a particular service for USABoutique, or the operators of the technologies that USABoutique uses for those services (typically programming or other technical support services, server services, email distribution, services related to measuring traffic to our site and tailoring content to user preferences);
persons who provide shipping services for USABoutique to customers;
persons who have placed elements on the USABoutique website that enable the collection of personal data or the tracking of the behaviour of users of this website (usually in pseudonymised form, i.e. without the possibility of obtaining direct identification data), i.e. in particular persons analysing traffic on our websites by means of cookies, and operators of advertising systems in connection with targeted advertising carried out using data on purchases made and data obtained from cookies (including remarketing).
In addition, USABoutique is obliged to transfer certain of your personal data on the basis of applicable law, e.g. to government authorities, courts or law enforcement authorities in connection with possible administrative, criminal and civil court proceedings.
 
5. What rights do you have in relation to the processing of personal data by USABoutique?
You have the following rights as a data subject in relation to your personal data:
    The right to withdraw your consent to the processing of personal data at any time (if the processing is based on consent, i.e. e.g. consent to the processing of personal data for marketing and commercial purposes; the processing of cookie data can be prevented by adjusting your web browser settings);
    Right of access to personal data (the right to request information as to whether or not personal data concerning you are processed by USABoutiq and, if so, the right to access such personal data and other information pursuant to Article 15 of the Regulation);
    The right to data portability (the right to obtain personal data relating to you in a structured, commonly used and machine-readable format and the right to transmit that data to another controller; and the right to have personal data transmitted directly from one controller to another controller where technically feasible);
    The right to rectification (the right to request that USABoutique rectify inaccurate personal data concerning you without undue delay);
    The right to restriction of processing (the right to request that USABoutique restrict processing, inter alia, if, in order to exercise the right to rectification, USABoutique verifies the accuracy of the data; or if personal data are unlawfully processed by USABoutique but you do not request their erasure);
    The right to erasure (the right to request that USABoutique erase your personal data without undue delay if, inter alia, the personal data is no longer necessary for the purposes for which it was collected or you have withdrawn the consent on the basis of which the personal data was processed by USABoutique and there is no further legal basis for the processing; or if the personal data would be processed unlawfully by USABoutique);
    The right to object (the right to require USABoutique to stop processing your personal data on the basis of a legitimate interest);
